Terms and Conditions

These Terms and Conditions apply to the purchase of tickets for, and attendance at, any Darwin Gamers LAN Party or related event operated by Majestix Media Pty Ltd trading as Darwin Gamers.

Darwin Gamers is the trading name of Majestix Media Pty Ltd ABN 90 145 305 611.

By purchasing a ticket, registering for, or attending the event, you agree to these Terms and Conditions.

Organiser

The event is organised and operated by Majestix Media Pty Ltd trading as Darwin Gamers. References to Darwin Gamers, we, us, or our mean Majestix Media Pty Ltd.

Tickets and Entry

A valid ticket is required for entry unless we state otherwise.

Tickets must not be resold for profit, used for promotion, or used for any commercial purpose without our written approval.

Tickets may only be transferred if we or the authorised ticketing platform allow it.

We may require proof of identity, proof of age, or proof of purchase before entry.

We may refuse entry or remove any person for safety, security, operational, legal, or behavioural reasons.

Entry is subject to venue capacity, safety requirements, and compliance with these Terms and Conditions.

Pricing and Bookings

All prices are in Australian dollars unless stated otherwise.

We may correct any genuine pricing, description, or availability error and, where necessary, cancel or adjust an order and provide an appropriate remedy.

A booking is only confirmed once payment has been processed and a valid confirmation has been issued.

Refunds, Cancellations and Major Changes

Your rights under Australian Consumer Law are not excluded, restricted, or modified by these Terms and Conditions.

Tickets are otherwise non-refundable for change of mind, non-attendance, late arrival, or where entry is refused or a person is removed for breach of these Terms and Conditions.

If the event is cancelled and not rescheduled, ticket holders are entitled to a refund of the ticket price paid.

If the event is rescheduled or materially changed, ticket holders will be offered any remedy required by law, which may include a refund where the change is major and the ticket can no longer reasonably be used.

Booking fees, payment processing fees, and third-party platform fees will only be refunded where required by law or by the applicable platform terms.

Except where required by law, we are not responsible for travel, accommodation, parking, meals, equipment transport, or any other incidental or consequential expenses.

Event Changes

We may change the date, schedule, running order, seating or table allocation, competitions, prizes, activities, venue layout, network arrangements, or event format where reasonably necessary.

We may move the event to another suitable venue if required for operational, safety, or legal reasons.

We will use reasonable efforts to notify ticket holders of significant changes.

Force Majeure and Safety-Driven Changes

We may postpone, suspend, cancel, interrupt, or alter the event where reasonably necessary due to circumstances beyond our control, including venue unavailability, power failure, internet or network outage, severe weather, natural disaster, public health issues, government direction, safety risks, civil disturbance, or supplier failure.

Nothing in this clause limits any rights you may have under law.

Age Requirements and Minors

The minimum age to attend the event without a parent or guardian is 16 years.

Attendees under 16 years of age may only attend if accompanied by a parent or guardian, unless we approve otherwise in writing.

We may require proof of age, parent or guardian consent, emergency contact details, or supervision arrangements.

A parent or guardian who purchases a ticket for, or attends with, a minor accepts responsibility for that minor’s behaviour, safety, supervision, and compliance with these Terms and Conditions.

We may require a parent or guardian to collect a minor who is refused entry or removed from the event.

Code of Conduct

Darwin Gamers is a community event. Attendees must behave respectfully, safely, and lawfully at all times.

Harassment, bullying, discrimination, intimidation, threats, abusive behaviour, violence, vandalism, unsafe conduct, intoxicated behaviour, unlawful conduct, or unreasonable disruption will not be tolerated.

Attendees must comply with all lawful directions from event staff, venue staff, security, emergency personnel, and authorised contractors.

We may suspend access, disconnect equipment, relocate an attendee, or remove an attendee for breach of this clause.

Venue Rules and Prohibited Items

Attendees must comply with all venue policies and all safety and emergency procedures.

We may prohibit or restrict items including unsafe electrical items, excessive power draw devices, unapproved networking equipment, weapons, or any item that creates a safety, legal, or operational risk.

We may require prohibited items to be removed from the venue and may refuse entry where that direction is not followed.

Equipment and Personal Property

Attendees are solely responsible for all equipment and personal property they bring to the event, including computers, monitors, peripherals, cables, networking devices, storage devices, accessories, bags, and valuables.

All equipment is brought at the attendee’s own risk.

To the maximum extent permitted by law, we are not responsible for loss, theft, or damage to attendee property, except to the extent caused by our negligence or as otherwise required by law.

Attendees are responsible for labelling, securing, and supervising their own equipment.

We may require equipment to be placed, moved, or disconnected for safety, power management, network integrity, venue access, emergency egress, or event operations.

Electrical Safety and Power Use

All electrical items brought to the event must be safe, in good working condition, and suitable for the venue power supply.

We may inspect, refuse, restrict, or disconnect any device, cabling, adaptor, power board, or appliance that appears unsafe, overloaded, damaged, unsuitable, non-compliant, or disruptive.

Attendees must not overload circuits, tamper with venue power infrastructure, run unsafe cabling, block walkways, or create trip hazards.

Only power arrangements approved by us may be used.

Network Use and Cyber Conduct

Any event network or internet access is provided as is for event participation.

We do not guarantee uninterrupted, secure, or compatible network access.

Attendees must not attempt to gain unauthorised access to any system, service, account, device, or network belonging to us, the venue, other attendees, or any third party.

Attendees must not conduct scanning, sniffing, denial of service activity, malware distribution, credential harvesting, piracy, copyright infringement, unlawful file sharing, or any activity that compromises safety, legality, privacy, performance, or the experience of others.

We may monitor, restrict, suspend, or terminate access to event network services to maintain safety, legality, and operational integrity, subject to applicable law.

Software, Content and Intellectual Property

Attendees are responsible for ensuring that all software, games, media, and digital content they use, store, transmit, or display at the event are lawfully obtained and used.

Attendees must not use the event to infringe copyright, trade marks, privacy rights, confidential information, or any other legal rights.

Health, Safety and Wellbeing

Attendees must take reasonable care for their own health and safety and that of others.

Attendees must immediately follow any emergency direction, evacuation instruction, safety announcement, or first aid direction.

Attendees must not interfere with emergency exits, firefighting equipment, first aid equipment, safety signage, cables, tables, walkways, or venue infrastructure.

For extended or overnight events, attendees are responsible for managing their own fatigue, medication, food, hydration, rest, and personal wellbeing.

Unless we state otherwise, sleeping onsite is not guaranteed and is at the attendee’s own risk.

Food, Smoking, Vaping, Alcohol and Drugs

Attendees must comply with all laws, venue rules, and event rules regarding food, smoking, vaping, alcohol, and drugs.

Smoking, vaping, and alcohol are not permitted at the event or venue at any time.

Illegal drugs are strictly prohibited.

Any attendee found smoking, vaping, consuming alcohol, in possession of illegal drugs, or affected by drugs or alcohol may be refused entry or removed from the event without refund.

Damage Caused by Attendees

Attendees are liable for any loss, damage, cost, or expense suffered by us or the venue arising from their negligent, reckless, unlawful, or intentional act or omission, including damage to tables, chairs, cabling, power equipment, network infrastructure, fixtures, fittings, or hired equipment.

We may recover reasonable repair, replacement, or reinstatement costs from the responsible attendee.

Photography, Video and Streaming

The event may be photographed, filmed, live-streamed, or otherwise recorded by us, media, contractors, sponsors, or other attendees.

By attending the event, you consent to your image, voice, and likeness being used by us and Majestix Media Pty Ltd for promotion, social media, marketing, community updates, archival, editorial, and related business purposes without compensation, unless otherwise required by law.

If you do not wish to appear in organiser-created promotional material, you must notify event staff on arrival. We will take reasonable steps to respect that request, but cannot guarantee that you will not appear incidentally in background footage or crowd imagery.

A parent or guardian attending with, or permitting the attendance of, a minor consents to this clause on behalf of that minor unless we agree otherwise in writing.

Privacy

We may collect, hold, use, and disclose personal information reasonably necessary to manage ticket sales, event administration, venue access, safety, communications, insurance matters, incident management, prizes, compliance obligations, and related operations.

This may include name, contact details, age verification information, emergency contact details, ticketing information, transaction records, and other information provided by you or your parent or guardian.

We may disclose personal information where reasonably necessary to ticketing providers, payment processors, venues, service providers, insurers, professional advisers, emergency services, regulators, or law enforcement.

Personal information will be handled in accordance with applicable privacy laws and our privacy practices.

Seating, Tables, Competitions and Prizes

Seat, table, or area allocations may be assigned, changed, withdrawn, or reconfigured at any time for operational, technical, accessibility, safety, tournament, or venue reasons.

Competitions, raffles, tournaments, or prizes may be subject to separate rules published by us. If there is any inconsistency, those specific rules prevail to the extent of the inconsistency.

We may substitute prizes with prizes of equal or greater value where reasonably necessary.

Refusal of Entry, Suspension and Removal

We may refuse entry, suspend access, disconnect equipment, restrict network access, or remove an attendee where we reasonably believe they have breached these Terms and Conditions, created a safety risk, acted unlawfully, damaged property, interfered with event operations, or failed to follow a lawful direction.

Where an attendee is removed for breach of these Terms and Conditions, no refund will be payable except where required by law.

Liability

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies you may have under Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.

To the maximum extent permitted by law, we exclude liability for indirect, consequential, special, or incidental loss, including loss of enjoyment, loss of opportunity, loss of data, or loss of profits.

To the maximum extent permitted by law, our liability in connection with the event is otherwise limited to resupplying the relevant services or paying the cost of having those services supplied again, or such other remedy as required by law.

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, that provision will be read down or severed to the extent necessary, and the remainder will continue in full force and effect.

Governing Law

These Terms and Conditions are governed by the laws of the Northern Territory of Australia and the Commonwealth of Australia.

Acceptance

By purchasing a ticket, registering for, or attending the event, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
